A Winthrop man with seven OUI convictions under his belt was arrested for alleged drunk driving in Revere on Tuesday, the Suffolk County District Attorney's office reports.
Joseph Limone, 61, was ordered held without bail at his arraignment in Chelsea District Court, the DA's office says, adding he was also charged with attempting to beat state troopers booking him with a bench. He was foiled because the bench was attached to the wall by a cable, the DA's office says.
Judge Diana Maldonado agreed with a request from prosecutors to hold Limone without bail pending a dangerousness hearing July 18 at which they will ask he be held without bail until after his trial.
"There's no excuse for a person with this driving record being on the road,†DA Dan Conley said in a statement. "If holding him without bail is what it takes to accomplish that, then we’re going to take that step."
Limone's seven prior convictions include one that was overturned last year by the Massachusetts Appeals Court, which ruled an off-duty Somerville police officer didn't have the right to detain Limone after Limone plowed into him in Woburn. Prosecutors have appealed that ruling to the state Supreme Judicial Court. His convictions date to 1970 and across three counties.
According to the DA's office, a state trooper noticed Limone driving erratically on Revere Beach Parkway around 5 p.m. When Limone pulled up beside a car he'd been honking at and began yelling at the driver, the trooper put on his blue lights, which made Limone leave and drive the wrong way down a side street, prosecutors say. When the trooper got to Limone, behind the wheel of his 1988 Lincoln Town Car, he was unable to produce a license or registration and reeked of alcohol, the DA's office says. He was unable to recite the alphabet, stand on one leg, walk a straight line or follow a pen's movement without moving his head. When the trooper put him in his cruiser:
Limone became extremely agitated at this point, using obscene language and allegedly telling the trooper, "Get the cuffs off me and I will [expletive] you up. Just you and me."
Upon arrival at the Revere Barracks, Limone allegedly kicked out the cruiser's right rear window. That action did not dissipate the strong smell of alcohol that had filled the cruiser after his arrest.
Limone was so combative and resistant outside the barracks that troopers were forced to discharge chemical sprays at him to transport him into the building. Once inside, Limone allegedly tried to swing a bench at the troopers, only to find that it was secured to the wall by a cable. At that point, he allegedly tried to pull the cable from the wall. Troopers again discharged their chemical spray to subdue him, then notified medical personnel, who treated him for minor, self-inflicted injuries to his hands and feet.
