Stoner arrested for pot possession

Cambridge Police report arresting a Dorchester man on a charge of possession of marijuana with intent to distribute following a traffic stop on Massachusetts Avenue at Amherst Street yesterday.

Thomas Stoner, 31, was arrested after officers noticed "an overwhelming smell of unburnt marijuana" and, during a search, found a pound of marijuana, a scale and $1,280 in cash, police say.

Police add Stoner was a passenger in the car. The driver was charged with operating with a suspended license.

If the cops found a pound of weed, a scale, and cash in the car, why was the passenger arrested and not the driver? I'm sure there's a good reason that I'm missing.

DISCLAIMER: I don't think anyone should have been arrested.

they usually wont arrest the driver if the stuff is on a passenger and said passenger takes responsibility for the stash.

My understanding of the law was that the smell of burnt marijuana was no longer probable cause to execute a search because it's not evidence of a crime occurring thanks to the 2008 change in the law. Unless there was evidence of some other criminal wrongdoing that led to the search, this guy's gonna walk unless his lawyer is totally incompetent.

which apparently still counts as evidence -- although how they could determine that they smelled more than an ounce is another question.
