Press release urging Kelly Timilty to retire

For Immediate Release: February 11, 2010
DEMOCRATS TO TIMILTY: DON'T RUN!

Nearly two dozen Democrats in District 2 of the Governor's Council so far have sent emails and letters to Kelly Timilty, asking her not to run for her ninth consecutive term on the Council because of the illegal tactics she used to win the last election.

"Your actions in 2008 to gain our Party's nomination for Governor's Council - blatantly misusing the Governor's name and forging his signature on your last-minute campaign literature - was a breach of ethics and a violation of the people's trust," reads one letter. "You committed fraud against the voters and against the Governor. For that you paid $8,000 in fines and apologized - to the Governor.  You never apologized to the voters you sought to dupe and defraud."

Mary-Ann Greanier, who also chairs the Plainville town committee, and her colleagues launched a campaign to ask Timilty to sit this one out after many of Greanier's colleagues approached her initially with outrage at Timilty's scheme and more recently with concern that she may seek another term. So far, nearly 17 people have sent Timilty letters and emails urging her not to run.

Just days before the September 2008 Democratic primary, the Timilty campaign illegally created and sent a flier to voters that featured a photo of Timilty with Governor Deval Patrick, according to Attorney General Martha Coakley's office.  The text of the flier purported to be a letter from the Governor supporting Timilty, including a reproduction of the Governor's signature copied from another document. The Timilty campaign did not obtain the approval of the Governor to use his endorsement, his signature, or the text that appeared on the flier.

Coakley charged Timilty with violating the law and assessed her a penalty of $8,000 - eight times the maximum penalty that could be imposed after a criminal conviction of falsely claiming an endorsement. She was also fined $1,000.00 for breaking the law by not complying with reporting her receipts and expenditures to the state Office of Campaign and Political Finance
Democrats who once had supported Timilty were outraged and no longer want to be represented by her.

"I am asking you to forego a bid for re-election to the Governor's Council," read a letter to Timilty from another district democrat. "If you do decide to run again, be advised that I and many other Democrats will work against you in every conceivable way.”
