Outbreak of similarly named businesses continues: One Newbury Street salon sues another with a similar name

Avanti Salon, 20 Newbury St., is suing the owner of Avani Aveda Salon, 75 Newbury St. for trademark violations, saying the newer place's name is deliberately confusing.

In a lawsuit filed in US District Court this week, Avanti is seeking at least $2 million in losses it says it will incur just this year due to people going to the wrong salon - plus damages and legal fees.

As of this morning, Avani Aveda's Web site and Facebook page were both disabled.

Avanti Salon, which has been in business at the swanky end of Newbury Street for more than 20 years, charges the owner of Avani Aveda knew the name would be confusing but went ahead with it anyway.

Last month, Milk Street Cafe sued celebrichef Christopher Kimball for opening a place down the street called Milk Street Kitchen.

In June, E.B. Horn sued another jeweler who opened a shop down Washington Street called Horn's Jeweler.

a new business setting up shop in Massachusetts was required to go through a review process to have its name approved before it could be licensed.. The idea was to avoid possible confusion by weeding out any proposed names that were the same as, or very similar to, existing businesses.

Sounds like it's time to reinstate this requirement.

One cannot establish a LLC/LLP/Inc unless it passes muster of the SOS name review. This does happen, however, its always possible for the LLC to have another store that runs under a different name.

Is there no review for DBAs? I guess I've always run my businesses under the same name as the LLC, so I'm not even sure how DBAs work around here.

$10? That's too much. I use hair clippers. $10 investment.....14 years of haircuts at home. I look just as good and I can do it often and don't have to wait at the shop.
