Owner of Framingham pharmacy that killed 64 convicted of racketeering, acquitted of murder

A federal jury today convicted Barry Cadden, owner of the New England Compounding Center in Framingham, of racketeering and related charges for the fungus-laced drugs that killed 64 people across the country, the US Attorney's office reports.

However, the jury acquitted him of second-degree murder charges.

Sentencing was set for June 21.

instead of using common sense. And a jury cannot say "We find him not guilty of murder, but guilty of negligent homicide" if that has not been given to them as an option.

any intentional murder with malice aforethought, but is not premeditated or planned


Despicable as he is, I don't think this defendant ran his business with a malicious desire to intentionally murder the people who received his products.

It seems a very hard charge to prove for this particular crime. If I were a juror, I'd be unconvinced. I agree with Roadman about the prosecutor making the mistake of overcharging.

Involuntary manslaughter — easy.

Mail fraud can get you up to 20 years as well. And I believe he was convicted of ~50 counts of that.

Whatever length of sentence he receives will not make up for the unimaginable pain he has caused the victims, their families and friends.
