There's safety in numbers, except in Greater Boston, according to lawsuit filed this week

A company called Boston Safety Training that offers workplace safety training, including first aid, has filed a trademark lawsuit against a company called Greater Boston Safety Training, which offers first aid and related training, including babysitter training.

Neither company is actually based in Boston - Boston Safety Training is headquartered in Abington, Greater Boston Safety Training in Woburn.

Boston Safety Training says that because the two companies are in the same basic field in the same basic area, potential customers are getting confused and that Greater Boston Safety Training needs to stop the nonsense immediately.

Boston Safety Training, which has been in operation since 2012, says it asked Greater Boston Safety Training to change its name this year but that the company ignored the requests, so it's been forced to ask a federal court to step in.

Defendant’s use of the Greater Boston Safety Training Mark has already caused substantial actual confusion in the marketplace between the Plaintiff and Defendant that cannot be undone. ...

Defendant’s violation of Plaintiff’s rights in its Boston Safety Training Mark is knowing, willful, deliberate, fraudulent, and intentional, and was made with knowledge that such violation would damage Plaintiff and its Boston Safety Training Mark.

Defendant’s actions have caused confusion, and are likely to continue to cause confusion, mistake or deception, all to Plaintiff’s irreparable injury and the Defendant’s unjust enrichment and benefit in violation of 15 U.S.C. Section 1114(a)(l) (Section 32 of the Lanham Act).

Just wait until they compromise and agree to both change names, and it turns out they both picked Not Especially Close To Boston Safety Training.
