Man learns you can't just hang with the Orange Line
Transit Police report educating a Jamaica Plain man on the finer points of subway law in the Commonwealth, specifically that there is a crime called riding upon a train other than as a fare paying passenger.
Police say Jonathan Lopez got this lesson around 8:15 p.m. on Monday at Back Bay station, where he and two pals were captured on video grabbing onto the top of an Orange line car and taking it for a ride down the platform. Police say:
This conduct is extremely dangerous and can be deadly. The Transit Police will not tolerate such conduct and will identify, locate and arrest anyone performing such deadly, criminal stunts.

If so, I fail to see how this stunt violates the cited law.

by hanging onto the train but not as a fare paying passenger (i.e. inside the train, where most people ride).
I basically agree with your point, but...
...maybe the trick word is "passenger"? From a legal definition of "passenger":
So that "duty of care" thing clearly can't apply to people hanging off the side of the train, and thus they aren't legally passengers.

I've always wanted to stand on the connector at the back of a green line train above ground and ride it for a few stops.
I never would actually do such a thing but it's a daydream nevertheless.

I once saw
A guy clinging to the handles on the back of a #1 bus (with his feet on the bumper) going across the Mass Ave bridge on a Saturday night. Once the bus reached the Boston side of the bridge, a cop saw him and pulled the bus over. Presumably he got in trouble after that.
Orange Line
I'm an old stick-in-the-mud I guess, but anything that delays the T I'm not in favor of, even if it spoils someone's fun. For Pete's sake, the Orange Line is crowded, dirty, delayed enough without individual hijinks.

when I was a dumb (dumber?) kid we used to grab onto the sides of the green line trains underground and "ride them into the sun" which was above ground, comm ave.
I wouldn't recommend it.
Jonathon got his 15 minutes of fame
The news coverage of this dangerous stunt made Jonathon a hero to the facebook generation. Other teens will surf the rails end up in the morgue and the T will be sued and taxpayers will pay millions in reparations to the surfers families.
