Man swings crowbar at Boston firefighter who caught him trying to break into his car outside Back Bay firehouse, police say

Boston Police report a firefighter leaving the Boylston Street fire station Sunday morning narrowly avoided having his head cracked open with a crowbar swung by a guy who was initially using it to try to break into the firefighter's car.

Police say the off-duty firefighter left the station shortly after 8 a.m. and spotted the guy using the crowbar - from the back of another firefighter's pickup - to try to get into his car.

The victim stated he confronted the male and asked him what he was doing. The victim stated the suspect then fled the area while the victim and two other firefighters gave chase. During the pursuit, the suspect stopped and swung the crowbar at one of the firefighters, just barely missing his head. Eventually, the suspect was apprehended. One of the victims stated the suspect had removed the crowbar from the bed of his truck which was parked in front of the firehouse.

Police say the firefighters chased Fernando Arroyo, 44, to Stoneholm Street and Edgerly Road, on the other side of Mass Avenue, where police caught up with him.

Arroyo was charged was assault with a dangerous weapon, malicious damage to a motor vehicle and stealing motor-vehicle parts.

Thievery. Thieves will avail themselves of tools they find that honest people don't consider a problem. The firefighter doubtless had a legitimate use for the crowbar he left in the bed of his truck. The thief sees it and decides to use it for his own purposes. Unfortunately, it means honest people have to consider the thinking of dishonest ones, and not make things easier for them. Don't leave ladders outside your house. Don't put a spare key under the doormat. For God's sake, don't leave your car running while you pop into the store or whatever.

...and take a few deep breaths, then try and understand that "arrest" and "prosecute" are not the same things. I'm sure a stable genius like yourself has never been a minor in possession of alcohol, or ever been worthy of a disturbing the peace or disorderly conduct charge. How are all the knuckle draggers out there so dumb as to not realize almost all of us have done something or been responsible for some of the behavior on this list, and that such petty offenses do not warrant a punishment of say, never being able to get a decent job for the rest of time. Or do they not realize that the inability to get a decent job might lead to...oh, i dunno...more crimes committed?

  • Trespassing
  • Shoplifting (including offenses that are essentially shoplifting but charged as larceny)
  • Larceny under $250
  • Disorderly conduct
  • Disturbing the peace
  • Receiving stolen property
  • Minor driving offenses, including operating with a suspend or revoked license
  • Breaking and entering — where it is into a vacant property or where it is for the purpose of sleeping or seeking refuge from the cold and there is no actual damage to property
  • Wanton or malicious destruction of property
  • Threats – excluding domestic violence
  • Minor in possession of alcohol
  • Drug possession
  • Drug possession with intent to distribute
  • A stand alone resisting arrest charge, i.e. cases where a person is charged with resisting arrest and that is the only charge
  • A resisting arrest charge combined with only charges that all fall under the list of charges to decline to prosecute, e.g. resisting arrest charge combined only with a trespassing charge

"Instead of prosecuting, these cases should be (1) outright dismissed prior to arraignment or (2) where appropriate, diverted and treated as a civil infraction for which community service is satisfactory, restitution is satisfactory or engagement with appropriate community-based no-cost programming, job training or schooling is satisfactory. In the exceptional circumstances where prosecution of one of these charges is warranted, the line DA must first seek permission from his or her supervisor. If necessary, arraignment will be continued to allow for consultation with supervisor. Thus, there will be an avenue for prosecuting these misdemeanors when necessary but it will be appropriately overseen by experienced prosecutors. Note: this is essentially already happening for drug possession cases in Roxbury and Dorchester District Court."

The loon-with-a-crowbar is being charged with: Malicious Damage to a Motor Vehicle, Assault by means of a Dangerous Weapon, and Stealing Motor Vehicle Parts.

A) Shoplifting should be prosecuted, not neccarily with a jail sentence, but that the offender(s) should be compelled to do some restitutionary services (i. e. some community service) in order to pay back the money for replacement of merchandise for the business(s) that the offender(s) have shoplifted from. Shoplifting, in itself, is a crime, which could cause the loss of one's scholarship if they have one. Also, shoplifting also forces business owners/proprietors to raise the prices on their merchandise each time it occurs. If shoplifting occurs enough times, it could force a business or business to fold, because people will no longer buy their merchandise at the business(s) in question.

B) Malicious destruction of property, theft: Yes, that, too, should be prosecuted, by the offender(s) being forced to do restitutive services.

comment-section refugees attacking Rollins here are dead effing wrong in this instance. What a surprise to see they're too chickenshit to admit it when it's spelled out for them.

You'll notice that the campaign stance leaves plenty of room for discretion on whether to prosecute any of these crimes: it's not a blanket "never prosecute ever". But it does require an ADA to refer a case they believe is worthy of prosecution to get approval from a more senior colleague.

IANAL, but most of these crimes look like misdemeanors to me. I tend to agree that in the case of felonies (as in felony malicious destruction of property vs. misdemeanor wanton destruction), I would hope to see more referrals for prosecution. I'd be curious to see how carefully Rollins's campaign promises are being carried out in current practice.

you would see in regards to your "A" point that instead of criminally prosecuting, they are diverting the cases to civil offences and punishments like community service and restitution JUST AS YOU DESCRIBE. READ. Again, READ "the list", its all there in neatly arranged groups of letters that carry meaning.
Aside from fear-mongering racist Faux-News trolls i really don't understand how sensible people do not get how her policy works. They don't just give shoplifters a pep-talk and send them on their way. They GET arrested. They GET booked. Then they get punishments as stated. They just don't get convicted of crimes which would show up on a CORI and ruin a person's life.
