A federal judge on Thursday let Joseph Fisher return to his Plymouth home to await further proceedings on federal felony and misdemeanor charges for his alleged participation in the Jan. 6 attempt to enthrone Donald Trump in a job voters had turned him out of.
Boston federal Magistrate Judge Donald Cabell ordered Fisher to stay away from Washington, save for any court appearances or attorney meetings following his case's transfer to DC court, to enroll in a "mental-health treatment program" and to report any contact with law-enforcement officials, except for those with his wife Debra, who is a Boston Police officer. Fisher was also ordered to "lawfully" remove any guns in their Plymouth home.
Fisher, who retired as a BPD canine officer in 2016, was arrested by FBI agents on Thursday on charges that include assaulting a Capitol Police officer with a chair inside the Capitol during the Jan. 6 rioting.
According to the FBI, Fisher shoved a chair into the cop, at the time pursuing another rioter who was spraying officers with pepper spray. Fisher, who took off his knit cap adorned with Celtics, Bruins and Patriots logos before entering the building, then grappled with the cop, who got the better of him and shoved him to the ground.

If there was ever something that warranted the death penalty, "I knowingly & willingly took part in a coup attempt to overturn the results of a democratic election" is the thing that earns it. Gallows, chair, or something more crude, ought to be game over for this crowd.

1. Lack of a criminal record
2. No defaults in appearing in court
3. Strong ties to a community
4. No indication of flight risk
5. Not likely to be sentenced to a long term of incarceration if found guilty
