That's a lot of gold bullion

A Suffolk Superior Court judge today set bail for the Suspect Formerly Known as Clark Rockefeller at $50 million in cash (or $500 million in assets), the Suffolk County DA's office reports. His attorney had sought bail of $25,000.

Trial was set for March 23, 2009 for those charges related to his alleged parental abduction.

Innocent, etc.

His lawyer protested "He's not one of the rich Rockefellers."

New flash, counselor: He's not one of the Rockefellers at all.

What makes the court think this guy - Christian Gerhartsreiter, Christian Gerhart-Reiter, Christopher Chichester, Christopher Crowe, Michael Brown, J. P. Clark Rockefeller, James Fredrick, Clark Mill Rockefeller, Charles "Chip" Smith, and Clark Rock - is a flight risk?

No bail means they can keep him until trial.

What they really want to know is if he murdered or was an accomplice to murder in California.

Hrones has a problem. It's one thing to make up names because you don't remember your own name. It's another to make up stories about the person you pretend to be for transparently obvious reasons. Hrones is hoping for a really stupid jury and he's not going to find one.

"The parental kidnapping suspect whom prosecutors once described as a “mystery man” was charged today with providing a false name to police in court papers naming him Christian Karl Gerhartsreiter, Suffolk County District Attorney Daniel F. Conley announced.

“The charge reflects this defendant’s prevarication,” Conley said, “and the complaint reflects his true identity.”

Furnishing a false name or social security number to police is a misdemeanor under Ch. 268, Sect. 34A of the Massachusetts General Laws and allows for up to one year in a House of Correction, a fine of up to $1,000, or both. The complaint for that offense filed today is the first piece of court paperwork to be filed under the defendant’s birth name.

“We identified Christian Gerhartsreiter after a comprehensive, multi-agency investigation,” Conley said. “We’re satisfied with that identification and certain that the Rockefeller alias he used was pure hokum.”

Assistant District Attorney David Deakin asked the court to continue holding Gerhartsreiter without bail; Boston Municipal Court Judge Paul K. Leary granted that request and ordered the parties to return to court on Sept. 30, by which time Deakin said he expects a grand jury to return indictments.

Gerhartsreiter is already charged with abduction of a minor by a relative, assault and battery, and assault and battery with a dangerous weapon. Those charges reflect the alleged abduction of his 7-year-old daughter in Boston’s Back Bay on July 27 and assaults on a social worker who was supervising their visit.

A Suffolk County court granted the child’s mother sole legal custody of the child in 2007. Under the terms of that divorce decree, the defendant was allowed three supervised visits with his daughter per year and kidnapped her on the first.

If released, he would fall into the hands of the INS and be deported (in fact, he could turn himself into the INS for deportation - they do that now). I'm not sure he would be returned to stand trial, as the offenses for which they have actual, solid evidence are really not that extreme.

without at least consulting the jurisdiction where he is charged? I hope not, anyway.

* (what used to be INS is now Immigration and Customs Enforcement, ICE)

A Suffolk Superior Court judge today revoked the $50-million bail set by a clerk magistrate a few days ago, ordering the Suspect Formerly Known as Clark Rockefeller held until his trial in March, the Suffolk County DA's office reports.

Judge D. Lloyd Macdonald ruled that Christian Karl Gehartsreiter's "ingenious capacity to transform himself" made him a rather poor choice for bail. "It's clear to this court that what's in the best interest of the public is for him to be held by the sheriff until his trial."
