Cambridge man charged with improper disposal of a body, but not murder

Carlos Colina, 32, of Cambridge, was ordered held in lieu of $1 million bail today at his arraignment on charges related to the discovery of a man's body parts in two different locations on Sunday, the Middlesex County District Attorney's office reports.
Colina was charged with assault and battery causing serious bodily injury and improper disposal of a body as detectives continue to investigate just how Jonathan Camilien, 26, of Somerville, wound up split between a duffle bag in the street outside 225 Binney Street and a nearby apartment building.
Based on their investigation, Colina could face additional charges, the DA's office reports, adding nobody else is being sought in connection with Camilien's death.

According to his Facebook page, Colina went to high school in Maine and was a bodybuilding fan.

He is likely very Cambridge in not owning a car, not being able to afford to park one there, or perhaps not having a license to drive! Human powered transportation didn't get him too far with his buddy's body. Perhaps he doesn't even have a Zip Car membership to go take his friend to a dumpster somewhere other than his neighborhood. I've been noticing stuff like
I've been noticing stuff like this more and more in criminal cases, where they start out by charging someone with a "lesser included offense," then as they develop the case and gather evidence, they eventually bring the full-on charge. I've wondered if this is a new strategy by prosecutors to avoid things like cases being dismissed for lack of evidence, then the suspect is let go until they can further develop the case and re-charge him.
In this case, right now all they have is a dismembered body found where it didn't belong; they probably "know" it's a murder but until they have enough evidence the only charges for which all the elements are met--and thus can justify holding the suspect--are things like improper disposal of the corpse and assault.

Hold and even try them on the lesser charges because a murder case takes a while to develop and won't make the speedy justice timeframe. Google doesn't turn up much on either guy. Perhaps the victim was from Brockton. One media report said family from both parties were in court, though seemingly no attempt to speak with them.

Cause of Death determines "murder"
And dismemberment is unlikely to be the cause of death.
They don't "know" any damn thing about cause of death until a) the pieces are collected and b) post-dissection damage is analyzed and then c) an autopsy can be performed which may or may not give them a cause of death.
In the absence of witness(es) or an obvious cause of death (bullet hole in head, guy's fired weapon, gunshot residue on hands), you can't make a "murder" charge stick.

The lesser charges are to get him to stick around and not to flee while a case is built or being investigated.
Anything less, he probably would flee. These charges just make sure he sticks around (or stays in jail)

And of course: Durst admitted to dismembering the body but was acquitted of murder. I haven't read detailed analysis of that case, but I did wonder if the prosecutors missed some opportunities to be a little more strategic in their charges. I don't know enough about the law, though, to really speculate much on that.
After being riveted by "The Jinx," though, I wondered -- uneasily -- if somebody might have been inspired by that case and the publicity it has received recently.
Eyes
Look at his eyes and facial expression. Now it's of course normal for people who've been arrested and are being booked to be stressed, but he's got the classic see-the-whites-of-the-eyes, anxiety / paranoid / mentally ill look. Think James Holmes, Adam Lanza, Jared Loughtner (sp?), any schizophrenic having an 'episode', etc. IMO this will turn out to be another case of serious mental illness, and he 'fell throw the cracks'. I'd be shocked if nobody knew he wasn't seriously mentally ill (especially family members), or if police found no prescription drugs for his condition. He probably should have been locked up for his own safety and the safety of others, but of course we just drug our mentally ill people up to the gills and put them back into 'the community'.

That photo reminds me of a character actor who ends up getting frequently cast in tv shows and movies as a killer or sex criminal - roundish, pudgy face, brown hair, no glasses, less heavy beard, been on SVU etc. Can't think of his name.
