Millennium Tower has been open for a bit now so it'd be nice if they'd hurry up and finish repairing the Franklin Street Orange Line exit. Its closure has added numerous hours onto many peoples commutes over the last year.

The BRA approved a design which -- legally -- can't be built? Or do the developers think they convince the FAA that their restriction was too restrictive?
It also says the BRA asked for an observation deck (Great idea provided it's public and free) yet Millennium didn't include one. Maybe they were concerned people would be hit by the landing planes?

Looking into the crystal ball.......... Oh the wonderful city of Boston the FAA won’t allow us to build that high. Due to cutting back 3 floors we can only provide the city with 75 million instead of the promised 150 million.

There is a lot of negotiation that takes place getting through these different phases. Millennium's documents acknowledge the height issue, but also discuss an approach for mitigating FAA concerns. Ultimately, either the FAA will get on board, or they will redesign with a compliant height. Same goes for the observation deck. The BAA can still insist on this feature, or they can instead use it as leverage to obtain something else. Ultimately, this proposal offered the city a great deal money than any of the others. I have to think that was the main attraction, especially considering NIMBY activists who have gone after the bidding process on concerns that the RFP would result in giving a sweetheart deal to a developer.
