Coming back on the ferry from Nantucket, Adam Markopoulos takes a photo of Bill Belichick and his girlfriend all cuddled and snoozing on the voyage and tweets it out. And then ESPN asks if it can run the photo "on all platforms." He replies:
No chance @ESPN, you started Deflategate.

But I also totally agree with the people on Twitter saying he shouldn't have taken that picture in the first place. How about some privacy for Bill and his girlfriend? I'm sure they'd appreciate that more than this dig at ESPN.

No expectation of privacy
There is no expectation of privacy in public. You can argue that it's nosy or intrusive, and I wouldn't disagree, but it isn't illegal (and honestly, it's something a fan would do, so this is just what public figures have to deal with).

I'm not sure where we got this idea that people have to get signed approval from you to photograph or video-record you. Not so, and not just for the hoodie class of celeb.
MA does have a odd law to give cover for cops mostly that you can't surreptitiously record a conversation. That is, in person or on phone or a net chat, you have to show your recording equipment or specifically say you're recording.
For all of us though, we should be aware that our best or worst behavior and words in public are just that — public. People have the right to record what we do...and publish it, within limits. The trouble comes and the reason there are model-release forms, is money.
You can search for Brandeis and privacy to trace the history of the legal definition of the concept and the history of legislation and case law following the first battle in 1902. The original cases involved a flour mill and an advertising company using people's images without their permission to promote products. That's still a no-no, and involves treble the revenue lost, plus punitive damages if you falsely accuse them of a crime or such, like being a brothel madam, drug dealer or murderer.
Consider instead if you are out on the street or at a public meeting, doing and saying whatever your impulses drive you to. You're fair game and your images and words can appear in print, on air or on the net. Your demanding the photog pay you or get permission is amusing but has no legal basis.

every bills fan i've met has been pretty stalwart, taking pride in that fact. as a fan of sports in general i've always respected that mentality.
especially as a huge fan of the celtics that was born in the 80s- too young to take notice of larry bird, et al, but old enough to remember the dream team (he was effectively done at that point) and also old enough remember all the lean years in between. obviously my patience paid off and i will always be very glad i was able to see many games in person when we had paul, ray, and kg.
2010 hurt though. rasheed wallace is my favorite all time player and if he had been able to grab a ring as a celtic too that would have really been amazing. there was a massive crowd of people watching the game at/outside CitySide and the disappointment was palpable.

Apparently his friend took the photo, which I'm sure most of us would do. But his friend did the right thing by not posting to social media. I would've took a photo too because I mean it is BB. In BB We Trust right? Actually I probably just would've waited until he woke up and thanked him.
As for ESPN, yes! I love the Boston pride, even if it is a bit silly.

They're not normal people. One of the consequences of being famous is having your photo snapped when you're in public. It's not a shot that invades privacy (e.g. in a bathroom, at an "up-skirt" angle, zoomed in to demonstrate a symptom of a medical condition, etc.). It's a harmless photo of them, and because he's famous, them's the breaks.

In general terms, "out in public", etc... yeah, at least for public figures. But...
Maybe I'm just thinking of use of the image - without permission of the subject. I remember watching on my Green Line commute one day as some art student doing a photography project - photos of T riders - got shut down because she wasn't asking peoples' permission to take/use their image.
Beyond the legality, it's just being a jerk to post that.

I'd use a harsher term for posting it to social media. Belichick isn't a celebrity like the Kardashians. He's not trading on his fame.
If I saw him I'd say something low key to him when he was awake. Or offer to buy him a drink. Wish the team good luck next week. I've done this before with "celebrities" and it's been appreciated. God knows the guy doesn't want to take a selfie with you.
Loser move taking the pic of them sleeping and posting it. I'd expect that from a Jets fan or some other hater.
