If the fire escape was in a public right of way and not properly marked, they might be able to go after the building owner and the rental company might help them.
As for the deposit, I suspect that it has been a long while since you rented anything. Last time I rented a box truck there was no deposit - they had my credit card number. The Collision Damage Waver should cover that, or any insurance program through the credit card they used.

...isn't thinking that s/he's ok because of having taken out the insurance Collision Damage Waiver.
Many years ago, I'd taken CDW, ran my rent-a-truck into an overhead tree limb in Somerville, and was informed on returning the truck that I owed Avis Truck a lot of money. It seems that the CDW does not cover "gross negligence," and that hitting an overhead obstruction is, by definition, gross negligence.
