Feds lie: They put that Iranian student on a plane 30 minutes after a judge told them not to
UPDATE: Judge dismisses the case because the student is already out of the country, so no longer under his jurisdiction.
Susan Church, one of the lawyers working to keep a Northeastern student from Iran in the country, reports that Customs and Border Patrol agents put him on a plane bound somewhere out of the US even as they were telling lawyers he was still at Logan:
JUDGE ORDERED client to remain in the US at 9:27 p.m. According to @SenMarkey office, he was removed from the US at 10:03 p.m. CBP officers told MULTIPLE attorneys that he was removed from the plane at 9:30/9:40 p.m. THEY LIED . The Federal Judge will handle this now.
A judge in US District Court in Boston had ordered Mohammad Shahab Dehghani Hossein Abadi kept in the US for at least 48 hours - and had scheduled a 10 a.m. hearing on his request to stay.

Much like the sentiment that he wouldn't want to be a member of any club that would have him, wanting to be a LEO should disqualify you from being one these days.
ICE agents, most sheriffs, etc... - 90% goons who just want to have power over others, not a single bit of interest in the greater public good. All to gain favor with a dotard and Stephen Miller. Mind boggling.
Don't bother calling a taxi.
Don't bother calling a taxi. just leave in a huff,
Wanna bet...
...that there are more people here who agree with him than not? Maybe you should get in that cab yourself.
CBP and ICE are America's
CBP and ICE are America's gestapo. Despicable agencies that shouldn't exist.
They should probably exist...
But shouldn't enforce rules and regulations that you feel are unjust correct? (Or ones that a federal judge tells them not to enforce which I agree)
Laws
I'm sure you know law enforcement and the legal system has a huge amount of leeway on which laws get enforced and how they get enforced.
The "just doing our job" argument doesn't hold up when agencies like ICE are willing to use deceptive tactics and outright lying to judges to move people which previously were not a target of these agencies, even if technically they are violating the law.
One wishes the Justice Department put as much resources into white collar offenses. There is no shortage of proud, naturally born Americans happy to use fraudulent tactics for massive personal gain and public expense.
Again...
If a judge orders you to do something, and you don't, you aren't "doing your job".
Someone broke the law here, and they should be held accountable. Getting rid of immigration officers isn't the answer.
If the immigration officers
If the immigration officers broke the law, they should be fired.
And barred from any future government service.
Correct
Getting rid of ICE isn't the answer to today's problem. It's the answer to the problems of the past 4 years.
EDIT: This doesn't mean the relevant functions shouldn't be done. However, they should fall under USCIS and be used only when necessary, not a paramilitary agency with its own recourse and budget to round up people.
Some of those laws should be
Some of those laws should be enforced, yes. But at this point, ICE and CBP have messed up in enough ways that they should be disbanded, and replaced with a new agency that doesn't hire anyone who worked for ICE or CBP. Start fresh with people who don't have ingrained bias and bad habits.
The bad apples have spoiled the whole barrel.
Do you know how many unqualified idiots you would get....
If you did something like that?
Start at the top, that should eliminate 99% of the problems.
Nah
Eliminate the whole goddamn barrel.
ICE didn't exist before 2000.
Ahhhh yea they did...
They were called INS. Same concept, same people.
If you worked for INS as an agent right after the Department of Homeland was formed, you became an ICE agent, or Customs Agent, of Homeland Security Agent.
Not so much
I know people who worked at INS then. It was nothing like these jackbooted thugs and liars.
Meh stories are nice....
I know probably more people who worked there then and now.
Have you seen an ICE agent today? Mostly polite men and women who are usually Latino, none of which I would describe as a jackbooted thug. Or are you talking about the ones you and I hear about on the internet? Yea, I can picture up an image in my head of them as well.
Your point is more like it, Pete Nice.
ICE went too far when they defied the Federal judge in question and put the Iranian student on a plane back to Iran despite being told not to.
No, I meant what I said.
No, I meant what I said. They didn't exist until 2003. Why do they need to exist now? They aren't making anybody safer, but they are doing harm. They should not exist.
INS did the same thing.....
They worked with the US Marshals, Customs, Coast Guard, etc....
Every country in the world has some sort of Immigration Enforcement, why wouldn't we?
Not for nothing...
...but if these agencies were created in 2003, then they were created to perpetuate false pretences with the "weapons of mass destruction" and unnecessary war. I agree we should have an immigration agency, but one with morale and an honest foundation. Not a bunch of people who were not pattiotic enough to deploy but racist enough to join these agencies
INS was also awful. What is
INS was also awful. What is your point here? Any form of authority has to demonstrate that it's legitimate. The mere existence of CBP, ICE, INS, or any of these other immigration enforcement agencies is not evidence that they have any justified reason to exist.
So if someone refuses to leave the country....
Or sneaks in illegally, or smuggles in Drugs or women, etc, who do you want to be in charge of keeping track of these people, and then transporting them back to their respective country, or filing out federal court complaints when federal laws are broken? The Boston Police? FBI?
The work is there in every country in the world. Immigration violations are a real thing and someone has to be in charge of them. Do we ignore them?
There is evidence of immigration violations, and that justifies having an agency which enforces immigration violations. Just like how the evidence of murders justifies a homicide division of the police department.
Fake moralization doesn't help
There need to be consistent guidelines on who gets a visa and who doesn't. There will always be a good decent person on the wrong side of the line wherever you draw it. What make CBP look incompetant is the fact that this visa was issued after a in depth investigation just a week ago. Why would this visa be issued if CBP would not allow him to enter the country? These are electronically recorded along with the plane tickets. Does CBP not have access to a list of people with visa's from Iran? What would create this kind of disagreement?
My logic towards ending them
My logic towards ending them (well ICE at least) is there probably shouldn't be a whole agency dedicated towards deportation. Even acknowledging deportation is sometimes an answer, a focus on this leads to a every problem looking like a nail when you have a hammer situation. Instead where deportation and investigation are necessary, we're probably better off making that a side function of the Marshals and FBI.
CBP and border patrol are trickier since there are functions that absolutely need dedicated people, but ICE seems superfluous to me.
Talk to your Squad Leaders
These Agencies were created by Congress
The Laws for which they were created to enforce were written by Congress
The funds paying their salaries were appropriated by Congress
Their uniforms and armaments were paid for by funds appropriated by Congress
The women and men of the Agencies in question [i.e. Officers] take an Oath to Faithfully Uphold the Constitution and to Discharge the Duties of the Office as specified in the US Statute written by Congress*1
Article One of the Constitution of the US -- provides a role for Congress and defines how it should function including the control of Immigration*1
1/2 of the Congress is in the hands of Your Squad and associated Fellow Travelers
Talk to Ms Presley -- as she is 1/4 of the Squad -- or in terms you might understand ==> an influencer for 1/2 of Congress

NOTE 1
nobody likes a pedant
all you’ve done is outline the reasons that ICE is allowed to exist, which is not at all the argument being made.
Great points!
We seem to live in a society where people can't be told that the answer to something is "no".
Focusing all your energies on ICE as the bad guy is misspent effort.
We are a country of laws. Don't like 'em? Change 'em!
If you're going to spray spit at your screen over Rep Pressley..
...could you at least be bothered to spell her name correctly?
Homeland Security is the American KGB
The KGB was not the Soviet CIA; it was a vast security apparatus that included also the border patrol, the coast guard, and the Soviet equivalent of ICE, and even its own army. You could tell a green-uniformed border guard from a regular Soviet soldier because the latter wore the letter "SA" (for "Soviet Army") on their shoulder boards, but the border guards wore "PV" ("Pogranichniye Voiska" = "Border Troops").
There were also grey-uniformed troops with "GB" on their shoulder boards (for "Gosudarstvennaya Bezopasnost" = "State Security".
In 2001, when George W. Bush proposed the creation of DHS, I opposed it, comparing it to the Soviet KGB, which indeed it has become: a huge bureaucracy driven by insitutionalized paranoia and the constant need to uncover enemies of the people in order to justify its existence.
I remember crossing the Soviet Finnish border in 1975, going to Moscow by train, and again a couple weeks later, going back to Helsinki. It was quite an experience.
CBP
I think you're being too hard on these poor banal bureaucrats. After all, they were just following orders.
Yikes. This is not a good
Yikes. This is not a good trend. CBP is arbitrarily denying Iranians entry to the US who have valid visas, particularly students.
https://www.theguardian.com/us-news/2020/jan/14/they-treated-me-like-a-t...
1980s
We did the same thing when Jimmy Carter was President. All the Iranian students were removed from the Country.
It was a sad time for those of us that had friends suddenly have to leave.
Any CBP personnel involved at
Any CBP personnel involved at the scene who thought it was a good idea to cross a federal judge in such a manner are either very stupid or have s very strong assurances that someone upstairs will broom this.
I'm guessing the CBP and ICE have political hacks as bosses....
Who will broom the upstairs like you said.
The judge surrendered. called the case moot.
https://www.bostonglobe.com/2020/01/21/metro/iranian-student-removed-us-...
Why was it approved last week? After making him wait a year, you would think every visa would get frozen because of recent events.
Different judge than ordered
Different judge than ordered the stay.
.
"Moot". I suppose.
Gosh darn it, but these comboxes make me cynical. Normally I would take the agency's word without question, but I have this inexplicable skepticism, can't imagine where it comes from, that makes we wonder if someone is lying about subject already being gone when the stay was received.
...or if two different administrations appointed the two judges.
.
Moot
Yeah, though with my thoroughly not-qualified-at-all background in law, let me have a moment to entertain the fantasy of the first judge issuing a bench warrant or something for contempt of court to those who refused to carry-out a valid court order.
.
I also find myself wondering if the cover/rationale would be that the student wasn't formally in country until/unless agency admitted him, therefore he doesn't have rights and court doesn't have jurisdiction.
This is what fascist
This is what fascist governments do
in a functional government,
in a functional government, the supervisor who approved him getting put back on the plane after recieving the judicial order for him to stay would be held in contempt and see jail time. in practice, it's the DoJ who would have to enforce that, and everybody knows Barr is happy to empower the trump-loyal, heavily armed, extrajudicial private army that makes up ICE.
the three branches of government no longer apply when one branch refuses to acknowledge the power of the other two. that's fascism.
I'm sure they're all sitting
I'm sure they're all sitting around laughing and high-fiving today for having scoffed at the courts.
I for one refuse to believe
that the federal government or one if it's agencies would ever LIE about anything.
You laugh, but as soon as they find the nukes in Iraq I shall be vindicated.

Millions of Iranians shouting "death to America" last week?
If we are to believe the media, tens of millions of Iranian people were just in the streets shouting "death to America." It would be malfeasance not to take all precautions. Studying in the United States is a privilege, not a right. I'm sure whatever classes he misses at Northeastern can be made up or perhaps he could do his co-op on traveling to the U.S.A. from the world's leading state sponsor of terror. I doubt the Iranian student expected the red carpet, only the far left did.
So many questions
Was this guy shouting "Death to America" before he was arrested? If all Iranians share the same views, do all Americans have the same political views too?
Should we assume you love Elizabeth Warren on the basis that she has millions of supporters in the US? That would be the safe assumption, right?
If someone in the US shouts, "Death to the democrats" should everyone else of same demographic be rounded up on the basis that they represent a potential threat to other American citizens?
Do you ever feel emasculated?
You know, from being afraid of young students?
"We are all sufferers from history, but the paranoid is a double sufferer, since he is afflicted not only by the real world, with the rest of us, but by his fantasies as well."
-Richard Hofstadter
We should punish the kid
We should punish the kid because of the country he comes from and because we heard secondhand some other people were shouting something? That's some solid trolling my friend, and a tip of the hat to you. I mean, even that was a coherent argument, why give him a visa then? Seems like kind of a tease!
I am way, way more terrified
I am way, way more terrified by living in the same country with millions of people like you than I am of what people in Iran are shouting or that one or two individuals who make it over here for school. The Iranians I've met here were some of the nicest people ever.
nope.
In addition to your clear lack of understanding of what Northeastern's co-op program is and how it works (you can't "do a co-op on traveling" somewhere), you also paint with a really xenophobic brush here. I'm sure there were just as many Americans (I wouldn't be surprised if you were among them) shouting to blow up Iran last week, but there's no basis for your implication that the illegally-deported student had any ill will towards most of America, though I wouldn't be surprised if that's changed in the past week or so considering how he was treated by idiots like you.
It would be malfeasance...
...not to run you in for questioning on a regular basis, given that the most common terrorist profile in America today is a white man.
Plus he is a right winger, as
Plus he is a right winger, as are most terrorists.
so
i’m fairly certain that O-FISH-L is a bot. same for that other ostensibly intelligent conservative guy that posts on here (can’t remember his username).
fish never responds to comments and his posts always contain some syntactical oddities.
what does this even mean? outside of hitting talking points, i can’t make practical sense of this sentence.
that said, i know it’s great to vent some frustration on here but he’s likely not real.
Occam's Razor: he's a typical right-wing dope
who believes what he hears on Russian state propaganda media (Fox News) and Iranian state propaganda media (that says tens of millions of people attended Solemeini's funeral and *all* of them were shouting "Death to America!")
He's just a gullible, hate-filled ding-dong, a useful idiot like the Dear Leader.
thing is
that in the world as it is today, it’s no longer that much of a jump to assume that nonsense online is written by a bot.
i think it’s actually more likely than not that if he were real he’d engage with people that argue under his posts. maybe he has incredible self control, but i know a few boomers and they love to argue.
I think it is possible, but unlikely. He's been
posting like this for years, and I don't think text-bots were that good a few years ago, at least not the kind that would be applied to trolling online discussions like this.
Another application of Occam's Razor: Fish doesn't reply because he doesn't have the intellectual wherewithal. All he can do is seagull it: drop his load of runny shit and flap away.
No, he's a troll
He's a troll that likes to "own the libs" and get a response to his "ruminations" from
various commenters on this blog. He's very successful at it.
I like this definition of "owning".
Fish: [some bigoted right-wing bullshit]
Rest of uHub: "Ugh, this dim, spittle-flecked douchewad again."
Fish: "Ha-ha, I owned the libs!"
Rest of uHub [giving Fish a pat on the head]: "Yes, yes you did. Now go play in traffic, Gramps."
Then rescind the visa before he leaves Iran
The State Department just issued the visa last week. If they weren't going to let him study here, they should have rescinded the visa before he got on the plane.
It's fun to see the pro-
It's fun to see the pro-"sanctuary" bunch complaining about government officials not following the law.
I don't think you understand how the "sanctuary" programs work
You might want to learn how laws are actually enforced and how separation of powers work before you start talking about it.
Sanctuary is a right wing fantasy
we seem to keep forgetting that counties stopped cooperating with ICE because they filled up the jails with civil detainments and then stiffed them on the bill.
Public health services don't report immigration status because they are afraid that people will won't seek treatment or immunizations out of fear of deportation.
Scariest part? Federal judge not even trying
From the BG article: 'At the scheduled hearing Tuesday morning, Judge Richard Stearns said the case was now moot, since the student was already out of the country. “There seems to be some history of CBP ignoring district court orders, which should concern the court,” Doyle said during the hearing. She asked that Hossein Abadi be returned to the US, but the judge said there was little he could do now that the student was gone. “I don’t think they’re going to listen to me," Stearns said.'
Whether or not you believe the Iranian young man should be allowed to study here, the process was rotten, and ignoring a Federal Judge should have consequences.
So...
that's it? Does ICE just get away with defying a judge's order?
