Owner of mall building next to Faneuil Hall Marketplace sues tenant for not paying rent during the pandemic
Gazit Horizons, which owns the newish retail building between Faneuil Hall Marketplace and the Greenway, the one that wraps around the space where the Faneuil Hall Christmas tree goes, is suing Ann Taylor for the nearly $254,000 it says the women's clothing chain owes for its Loft store there.
In a suit filed this week in US District Court in Boston, Gazit says Ann Taylor hasn't paid its rent for April, May and June for the roughly 6,000-square-foot space that the chain closed as part of the statewide retail shutdown in March. Gazit wants its money now - plus interest and lawyers' fees.
Yesterday, the BPDA threatened Ashkenazy Acquisition Corp. that it would seek to regain control of the city-owned Faneuil Hall Marketplace if that company didn't begin to help its retailers better weather the Covid-19-forced shutdown and gradual re-opening. But the BPDA emphasized its concern was with the small, locally owned retailers in the marketplace.

Empty Storefronts
A big chunk of the ground floor of that building both across from the Black Rose and near the Aquarium T stop entrance is perpetually empty, and has been for years. It's unsightly. For a while the people who put those fake window displays in empty storefronts had displays there, but even that stopped.

I suspect that the store has
I suspect that the store has no intention of re-opening and both parties know this. Otherwise I doubt party one would have not paid pent and I doubt party 2 would be suing if it thought their good old tenant was going to come roaring back and be productive. Large owners have been known to hold out for a decade or more for a decent paying large corporate brand. I doubt they would risk losing such a tenant if they thought ten more years of lucrative rent and customer attraction for other businesses was in the cards.
From where I sit and watch this drama I do not have a player I am rooting for here. Neither is a small company and both should have enough dollars in their piggy banks to handle this. I do not think the area loses anything with a loss of this store and it is not small/local so whatever.

I was at FH/Quincy Market the other day. Only a handful of food vendors were open. The place was dark and uninviting (probably to save money on electricity). The food was under heat lamps and the food looked sad and unappetizing.

should let them proceed with this to an actual trial. Impanel twelve jurors, have both sides make their arguments, and let's see who ends up paying whose attorney fees.
Spoiler: I sat on a jury for a broken residential lease about five years ago, where the letter of the law was probably on the plaintiff's side, but the defendant was a new mom whose life and sleep had been ruined by her landlord being shitty. Guess who paid for everybody's attorneys? Now apply that to a pandemic.
