Man charged with running down pedestrian in Mattapan while in reverse and drunk
A Mattapan man was indicted earlier this month on charges he killed a man just standing on the sidewalk on Cummins Highway last November.
Dervin Hibbert, 53, was arraigned today in Suffolk Superior Court on charges of manslaughter by motor vehicle and motor vehicle homicide while operating under the influence, which carry minimum mandatory terms of five years and one year, respectively, the Suffolk County District Attorney's office reports.
According to the DA's office, Walter Harris, 48, was standing outside Crest Liquors around 8:30 p.m. on Nov. 23:
Hibbert pulled into the parking lane, [Assistant District Attorney Ryan] Mingo said, then accelerated in reverse at a high rate of speed. His SUV traveled up onto the sidewalk for several car-lengths, striking Harris and dragging him for several feet. Harris was killed instantly. Hibbert was traveling at such a high rate of speed that the vehicle tore a fire hydrant out of its mounting in the ground.
Hibbert attempted to drive forward but was stopped by witnesses. When told he struck someone he became hysterical and was transported to Brigham and Women’s Hospital. Clinical blood work undertaken by hospital staff was subpoenaed by prosecutors and revealed a blood-alcohol level of .14, well above the legal limit for driving.
A court clerk set bail at $5,000.

Just so you know, the family has been agonizing over their loss (Mr. Harris' death) since the tragedy. The family had to go through great lengths for the DAs office to even hear them. The driver was NOT arrested, and is NOW just being charged with Mr. Harris' death.
Now we know
Now we know what it takes to get indicted for manslaughter by motor vehicle in Massachusetts; driving backwards down the sidewalk while drunk. Other than that, stomp on the gas and carry on!!
