A Prudential Center-based firm that helped Twitter sue Elon Musk when it seemed like he was backing out of his $44-billion takeover is suing the company for the $2 million in consulting it says it provided that the Musk-owned social network is now refusing to pay.
In its suit, filed in US District Court in Boston yesterday, Analysis Group says a contract is a contract and Musk needs to pay up. Last month, Charles River Associates, also headquartered in the Back Bay, filed a similar suit over consulting work it did for Twitter over the suit it had filed in Delaware chancery court.
Analysis Group said that not long after Twitter sued Musk in July, 2022, its lawyers hired the company "for analytical services in support of expert opinions, as well as economic consulting assistance to Counsel, in furtherance of Twitter’s legal position in the Musk Litigation." Twitter signed the contract, as did its two primary law firms, the suit says.
At the direction of Counsel, on an extremely expedited basis in the highest of stakes litigation, AG assembled multiple teams of professionals to support a number of testifying experts' opinions that advanced Twitter’s interest in the Musk Litigation. AG performed all requested expert consulting services to Twitter and its Counsel pursuant to the terms and conditions of the AG Contract.
The company says Twitter paid two invoices as the case was proceeding, but that after Musk took over Twitter, his new baby refused to pay a third invoice of $2,186,876.47 and that nobody at Twitter will now return its e-mails or phone calls. The company says that applies equally to a separate $50,000 fee it paid to a third contractor at Twitter's request, with the promise Twitter would reimburse it, which Analysis Group says it has not.

This is two businesses that had an agreement on a particular body of work and the business who performed the work, not getting paid for that work.
