Police: Rush-hour Red Line groper arrested

MBTA Transit Police report arresting a Maynard man on charges he indecently assaulted a woman - twice - on an inbound Red Line train around 8:30 a.m. on Oct. 3 after the train left Charles/MGH.

Ashish Mittal, 38, was arrested yesterday on a charge of indecent assault and battery, police say.

Is Nutella nuts?

For years, our own Boloco has sold a Nutella milkshake. Soon, no more. Seems Big Hazelnut objects to the use of the name, to the point of threatening legal action, so Boloco's now looking for alternative, preferably locally sourced, hazelnut spreads.

Andrew Sellars, a lawyer, explains why Boloco could actually have a case, although he allows as how it's probably not worth all the trouble - and legal fees. Still, he adds:

[W]hen I was in Boloco today (field research!) I couldn't help but see the dozens of jars of Nutella in the back, and thinking about the dozen-or-so other locations around Boston with similar stacks of Nutella jars. Those will be replaced by a competitor's product, in a chain that seems to be growing with each passing month. Not to mention the thousands of Bostonians who have heard about this case and will naturally root for the local guy; you get the feeling that this whole experience is going to leave a bitter taste in their mouths.

Two more charged for BU robberies

Brookline Police report arresting two more teens for the four armed holdups near the BU campus over the past couple of weeks.

Taquari Milton, 17, of Roxbury, and a second teen too young to be publicly named, were charged with two counts of armed robbery, for incidents on Sept. 25 and Oct. 5. They are scheduled for arraignment Monday in Brookline District Court, police say, adding the younger teen turned himself in.

Man freed on murder conviction found not guilty of drug possession

A Roxbury District Court judge today found Shawn Drumgold not guilty on charges of possession of cocaine and heroin for his arrest last year, the Suffolk County District Attorney's office reports.

Drumgold, who spent 15 years in prison for the murder of Tiffany Ann Moore before being released after prosecutors agreed he didn't get a fair trial, was freed after prosecutors failed to convince Judge David Weingarten he was the owner of drugs found in a Roxbury house in January, 2011. In a statement, the DA's office says:

Weingarten's decision was based on prosecutors' theory of possession, and not any issues surrounding the testing of those drugs: former DPH lab employee Annie Dookhan was neither the primary nor the confirmatory chemist on the case and her role in the Drumgold matter was to sign the drug certificates as a notary public. Those certificates plainly show that two other chemists -- who are not under any suspicion -- performed the testing.

In 2006 and again in 2009, Drumgold had pleaded guilty to similar drug-possession charges in cases in West Roxbury and then Dorchester.
