Boston Police report arresting a Dorchester man and seizing heroin, marijuana, an assault rifle and more than $10,000 in cash in a raid Thursday afternoon.
Police went into 14 Rosseter St. around 12:50 p.m. Among their items seized: 42 grams of heroin and 14 bags of pot.
Arrested: Damion Johnson, 23, of Dorchester, charged with trafficking heroin, second offense, distribution of heroin, possession of marijuana with intent to distribute, unlawful possession of a firearm and unlawful possession of ammunition. He was also charged as a Level II armed career criminal, which could mean longer sentences if he's convicted on the other charges.
Dorchester Municipal Court Judge James Coffey set bail at $50,000, according to the Suffolk County District Attorney's office, which says Johnson was convicted in 2011 for possession of marijuana with intent to distribute and distribution of both Class A and Class B drugs.
The DA's office provides this account of his arrest:
[Assistant District Attorney William] Kettlewell told the court that Boston Police conducting a drug investigation in Dorchester late Tuesday morning observed Johnson enter the rear seat of a waiting vehicle that then drove around the block to the exact location where it had previously been parked. Johnson then exited the vehicle.
Recognizing this “ride to nowhere” as a sign of drug distribution, officers stopped the vehicle, spoke with the occupants, and recovered three plastic bags of heroin and three containing cocaine.
The following day, police observed Johnson again enter the back seat of a waiting motor vehicle and take another apparently pointless ride before exiting at the same location, prosecutors said. Believing that they had once again witnessed a drug transaction, officers stopped the vehicle and recovered one plastic bag containing heroin.
Officers made similar observations once again yesterday, prompting officers to stop the vehicle. The individual inside the vehicle appeared to be swallowing something when approached by police. He was questioned and released.
At the same time, additional officers attempted to approach Johnson with the intent of placing him under arrest. Johnson, however, fled into his Rosetter Street apartment. Officers were allowed inside by another resident of the apartment and placed Johnson under arrest.
Johnson was arrested in the Back Bay in October on a charge of assault with a dangerous weapon.

Why was this person not fined for violating the city AWB ban? If they are a repeat offender, then why haven't they been charged for the two and half year sentence? Why isn't the city enforcing the law to hit criminals in the pocket book and keep them off the streets for bit longer?
AN ACT RELATIVE TO ASSAULT WEAPONS IN THE CITY OF BOSTON.
Be it enacted, etc., as follows:
SECTION 1. For the purposes of this act the following words shall have the following meanings:-
(1) "Assault weapon", all rifles and shotguns designated as assault weapons in this section and all other semi-automatic rifles and shotguns which are determined by the assault weapon roster board, established under the provisions of section five, to be assault weapons. Such term shall include, in addition to any other rifles and shotguns identified by said board, all versions of the following, including rifles and shotguns sold under the designation provided in this section and rifles and shotguns which are substantially identical thereto sold under any designation:-
(c) AR-15 semi-automatic rifles;
SECTION 2.
In the city of Boston, it shall be unlawful to sell, rent, lease, possess, purchase, barter, display, or transfer a large capacity magazine or a large capacity ammunition belt.
SECTION 4.
Any person who violates the provisions of this act as to an assault weapon shall for a first offense be punished by a fine of one thousand dollars, and for any subsequent offense by imprisonment for not more than two and one-half years.
Any person who violates the provisions of this act as to a magazine or an ammunition belt shall for a first offense be punished by a fine of two hundred dollars and for any subsequent offense by a fine of five hundred dollars.
SECTION 8.
This act shall take effect upon its passage.

Because as the poster above you noted, it is a .22 caliber rifle that looks like a "scary" AR-15. It is not an assault weapon. A felon or a criminal without a proper license should not posses it either way, but the law you referenced does not apply to this firearm.

The language "substantially identical thereto sold under any designation" would make any firearm patterned off the AR-15 verboten in Boston regardless of the caliber.
