DA: At least one of the schoolyard gunfighters arrived on bicycle

A Dorchester man accused of shooting up a schoolyard as kids played in a playground next door on Sunday was ordered held in jail at his arraignment yesterday, the Suffolk County District Attorney's office reports.

Prosecutors had asked for $100,000 bail for Semaj Leary. Judge Debra DelVecchio set bail at $10,000, but agreed with prosecutors to revoke his bail for an open assault-and-battery charge - for which he is scheduled for trial in June.

Prosecutors say that gang-unit cops - patrolling the area around the Trotter School on Humboldt Avenue due to an increase in gang activity - heard shots around 5 p.m.

As they approached, officers observed adults and young children fleeing from the school yard, as well as two males riding BMX bikes toward the rear of the school. Officers turned the corner and encountered a man later identified as Leary. After making eye contact with one of the officers, Leary took off running. Officers observed that he attempted to replace a silver firearm into his waist pocket as he fled, prosecutors said.

Officers pursued Leary through multiple fenced yards along Harrishof Street before losing the suspect; additional officers located him hiding under a nearby Nissan Rogue. ...

Among the witnesses at the scene was an off-duty Massachusetts state trooper who described two teens fleeing the scene on bicycles. A search of their path of flight turned up a second handgun that Boston Police seized as evidence.

advocating for equal and fair treatment of ALL criminal suspects by basing their charges, trials, and sentences (if found guilty) soley on the crimes they are accussed of comitting with the delusion that I'm somehow "pathologically afraid of teens"?

Perhaps you should talk to some of the people who've been robbed by your precious "juveniles". I'm pretty confident that they likely don't give a rat's @$$ about the suspect's age.

society has apparently decided that assualt, robbery, murder, rape, etc. are now considered non-serious crimes when committed by "juveniles", and that we condone this behavior by giving such suspects preferential treatment in the form of a closed court system, shielding identities, reduced or suspended sentences, and sealed records.

Because apparently acknowledging the severity of the crimes, and requiring people to actually take responsibility for their actions - regardless of their age - is such a bad thing. And, as I once indicated to Ms. "juveniles can do no wrong" Swirls, we're not talking about a six year old who swiped a candy bar from the corner store here.

Want to argue "mitigating circumstances" or "poor impulse" or all the other "excuses" the "scientists" have been brainwashing the general public with over the years? Fine, then let the defense do that at trial, just like they'd have to do with any adult suspect.

No, that's not at all what "society" has decided, but I don't blame you for being angry if that's what you really believe (doubtful, but possible). It's not that the crime is "less serious" in its consequences -- obviously it's identical -- it's that juvenile perpetrators are more impulsive, less mature, and less experienced than adult perpetrators. They are less likely to have full comprehension of the consequences of their actions, for themselves or for their victims. They're also more likely to be capable of being changed for the better, which is greatly reduced if you throw them into an adult population. So there's a difference both in why the crime is committed, and in what you can possibly do with the criminal.
