I'm not sure this one is President Obama's fault unless he really is the immortal anti-Christ that a lot of people apparently think he is. This person will be charged under a statute that might date from the 18th Century. It's possible it might have even been in the colonial statutes of the 17th Century that were moved in the General Laws after independence. If I have time later, I'll check.

I'm more freaked out at HOW they found footage of him from new sources.
There was absolutely nothing in the original photo to suggest that he stopped at a Walgreens prior to his BJ in the subway. Did they watch the reverse footage from the T Station and watch him come from that Walgreens and then go over there and ask for the footage in pursuit of an investigation (does Transit PD even have that authority? Did they get a search warrant for the footage? Over a subway BJ?).
Also, what camera shot that middle shot? Hip-high on the sidewalk? Are there cameras in the backs of street parking meters now?
This follow-up is more bizarre than the initial act having taken place in the first place.

The Transit police is very good about following up on any crime that happens in their stations. They simply go to Walgreens or any other business in the area that has cameras and asks them if they could view the video tapes. Most times the businesses will simply give the police a zip drive with the time frame requested. A high profile case like this is going to be assigned a higher priority as well.
As for the camera shot from eye level, I do not know, but the T does have other cameras around.

Sure, we all think we know what is going on, and maybe we're right, but based on this photo/still, what can he or she be criminally charged with? Perhaps there is more to the video or other angles, but unless there are witnesses who saw more than the MBTA photo, no criminal behavior here.

Not worthy of sex offender registry
That is not what the sex offender registry is for. There are already far too many people already on it who do not pose a threat to anyone, sometimes for completely non sexual acts and for what they did as a minor. Being on the registry can ruin your life and the lives of your family. It can open you up to harassment and threats and prevent you from getting a job. Sex offender laws desperately need to be reformed.
