Woman charges she was sexually violated in Logan searches

A woman who says she was forced to undergo a body cavity search each time after she and her daughter returned to Logan from trips to the Dominican Republic is now suing Customs and Border Patrol.

In the suit, filed today in US District Court in Boston, Neisa Ortega and her daughter over searches and exams that went on for hours after four separate trips in 2019 and 2020. Ortega is a permanent resident; her daughter is a US citizen.

The individual CBP officers who searched and seized Ms. Ortega and N.Z. had no legal basis for their behavior. Moreover, the fact that CBP’s April 2019 searches of Ms. Ortega revealed no evidence of drugs or other contraband only reinforced that they had no reasonable suspicion for
any of the subsequent searches. Further, the CBP officers who detained and searched Ms. Ortega failed to follow CBP’s own internal guidance and instructions on searches and seizures. In particular, CBP officers are prohibited from performing body cavity searches, including vaginal cavity searches. Vaginal cavity searches may only be conducted by medical practitioners at a medical facility and only in the most exceptional of circumstances.

Ms. Ortega and N.Z. fear that every time they travel, they will be forced into a small room and abused by CBP officers who rely on scant to no information to justify their illegal behavior.

They are seeking an end to the practice and damages.

The use of initials for the daughter suggests that she may have been a minor at the time of the searches, in which case this is especially disturbing.

Really gross, but if you're travelling very frequently it's wise to the the Pre-Check. It's ~$50 for 5 years and you don't get molested.

End this federal jobs program for unemployable sociopaths. Just give them the damn checks like we did during COVID, and tell them to stay away from others. Stories like this are a terrific argument in favor of UBI.

What it suggests to me is that the internal culture at CBP supports systematic harassment of someone whom they decide they don’t like. For example, if someone once has the temerity to have brown skin and to complain about their treatment, then some thin-skinned bully enters some code in some database that indicates that this person is a troublemaker who should be taught a lesson.

You did say something that as best I can tell from the complaint is factually incorrect. I see no mention of the child being searched in the same indefensible manner that her mother clearly was.

Otherwise, I'm inclined to agree with what you are saying.
