Condo association at pricey Back Bay building goes to court to make one owner stop screaming

The condo association at One Dalton - the Back Bay tower that also includes a Four Seasons Hotel - today sued the owner of a 35th-floor unit they say has disregarded repeated entreaties and even fines to stop screaming, playing loud music and partying at all hours of the night.

In a suit filed in Suffolk Superior Court, the Trustees of the Private Residences at One Dalton are seeking an preliminary injunction to order Jiacheng Sun to knock it off at least until they can make their case to a jury why they need a permanent no-screaming order.

The association, which represents the owners of the 61 condo units in the tower, said Sun has blithely continued to make "excessive noise which is destroying his adjoining neighbors' ability to peacefully reside in their own Units:"

More specifically, at late hours in the evening and early hours of the morning, the Defendant is shouting, having parties, have loud and audible conversations in Common elements and is generally a disturbance to his neighbors. Additionally, due to Defendant's disturbances and noise, adjoining neighbors are regularly unable to sleep at night.

In their complaint, the trustees say they asked Sun politely several times earlier this year to cease the screaming and music they say would start around 11 p.m. and sometimes last until 7 a.m.

When that didn't work, they followed up three times with fines - now totaling $6,000 - and then with letters from a law firm warning of possible legal action.

On Nov. 28, the law firm notified Sun that he was being fined for violating the no-screaming policy for two nights, both of which the firm says came after it had notified him on Nov. 21 to cease with the screaming, but that just as important, a lawsuit was imminent.

Sun paid $2.23 million for his 897-square-foot 1-bedroom unit in July, 2022, according to Suffolk County Registry of Deeds records.

He has until April 16 to file an answer to the main complaint.
