House of Blues worker fired for restroom sex

A male employee of the House of Blue was fired after he was discovered having sex with a female patron in a second-floor men's room in November, the venue's manager told the Boston Licensing Board today.
Boston Police initially investigated the incident as a possible rape, but a detective from the BPD sexual-assault unit told the board evidence showed the encounter was consensual.
Dennis Quilty, the House of Blues' attorney, said the incident early on Nov. 17, was first reported to House of Blues security staff by another patron. He said bouncers immediately went into the men's room, where "they discovered two pairs of legs in a stall" and told the two people to get out. The woman, he said, then paid her bar tab and left with a friend.
Qulity said that as a result of the incident, the venue is adding cameras to the hallway outside its restrooms.

Actually, yeah
You might have missed the part in my post (or maybe I didn't write it clearly enough), but this was initially reported as a possible rape case involving a HoB employee. Certainly seems hearing worthy to me.

But you also reported that the initial investigation determined that the sex was consensual and no rape occurred. Has the liquor licensing authority now claimed the power to separately conduct a redundant investigation once the police and/or courts have determined that no crime occurred?

If she's drunk....
If she's drunk and hasn't meaningfully consented, then it's rape. And if the woman had claimed rape, then I'd be all in favor of prosecuting the employee and also holding a hearing before the licensing board. But if both parties are claiming it was consensual, then I don't see why the licensing board needs to get involved.

Two things
1. the investigation took place to determine whether or not a crime occurred, and concluded that it didn't.
2. I would bet that the employee was fired for shagging on the clock and creating trouble for the employer in doing so, not because any legal or license proceeding demanded that his employment be terminated.
It's a liability issue for the bar
Scenario: male bar employee has what they believed to be consensual sex with female on bar premises, female claims afterwards it was nonconsensual (that they were forced, or that they were drunk, and incapable of consenting), bad PR and possibly civil suit against bar.

Should I not have done that? I tell you, I gotta plead ignorance on this thing, because if anyone had said anything to me at all when I first started here that that sort of thing is frowned upon... you know, cause I've worked in a lot of offices, and I tell you, people do that all the time.
As my international relations league advisor in high school said
... "the key is to BE DISCREET! If you don't get caught, I don't get woken up, and it didn't happen."
This has actually been determined to be a very important piece of life advice (now that most of us are in our 40s and 50s).

Yes, and that investigation was conducted by the police. From where does the licensing authority get the authority to conduct a second investigation at the establishment's expense?
What good will cameras in the hallway do?
Women frequently use men's rooms because empty stalls are easier to find.
If the couple had used the ladies, other women would be less concerned of a possible rape, but again, an empty stall is easier to find in the gents.
What....no names of the shamed?
